TERMS & CONDITIONS
1. In collaboration with Lotuss Stores (Malaysia) Sdn Bhd, a corporation duly organized and existing under Malaysian law, with its principal office at Level 3, No.3, Jalan 7A/62A, Bandar Menjalara, 52200 Kuala Lumpur, Malaysia ("Promoter"), TLC Marketing Worldwide (Singapore) Pte Ltd, a company duly organized and existing under the laws of Singapore (UEN: 201923399W), with its principal office at 1 Harbour Front Ave, Keppel Bay Tower, #05-02 Singapore 098632 (“Administrator”) is managing this “Beli-Beli. Cuti-Cuti.” promotion (“Promotion”) and responsible for the redemption of the Hotel Cash Vouchers under this Promotion.
2. Instructions on how to enter the Promotion and, how to redeem the Hotel Cash Vouchers form part of these Terms and Conditions.
3. Participation in this Promotion is deemed acceptance of these Terms and Conditions.
CONDITIONS OF ENTRY
Any person intending to enter this Promotion (“Entrant”) must meet all the following conditions:
4. This Promotion is only open to Lotus’s customers aged 18 years and over, who remain residents of Malaysia for the duration of the Promotional Period.
5. The Promotion is only applicable for customers who make the purchases at Lotus’s stores and Lotus’s Shop Online.
6. This Promotion is not applicable to wholesale purchases from distributors and/or traders and any purchases on other online platforms, including but not limited to Grab, FoodPanda, Lazada, Shopee, MyKasih, etc.
HOW TO ENTER PROMOTION AND REDEEM HOTEL CASH VOUCHERS
7. The Promotion starts at 12.01am (local time) on October 17, 2024 and ends at 11:59pm (local time) on December 11, 2024 (“Promotional Period”).
8. To participate in the Promotion, Entrants must:
i. spend over RM200 and over in a single receipt at Lotus’s stores or Lotus’s Shop Online during the Promotional Period (“Qualifying Purchase “) to redeem hotel cash vouchers worth RM200 (2xRM100) (“Hotel Cash Vouchers”):
ii. Within three (3) days from the date of receipt of the Qualifying Purchase, Entrants should scan the QR code and visit the Promotional website https://www.belibelicuticuti.com/ managed by the Administrator (“Promotional Website”), where they are required to fill up Participation Form, (“Participation Form”) upload the official receipt (“Proof of Purchase”), receipt transaction number and agree to the Terms and Conditions of the Promotion and the Privacy & Cookies Policy.
iii. Administrator will verify entries and reach out to successful Entrants via email within five (5) business days.
iv. Each successful Entrant will be granted Hotel Cash Vouchers (2xRM100).
v. If an Entrant’s entry is successful, Entrants will receive an email from the Administrator via contact@belibelicuticuti.com within five (5) business days confirming their successful entry to the Promotion and there will be instructions on how to utilize the Hotel Cash Vouchers.
vi. If an Entrant’s entry is unsuccessful, Entrant will receive an email from the Administrator within five (5) business days stating their ineligible entry.
vii. Entrants will be given the username and pin by the Administrator for the login at the hotel booking website https://en-my.travelcredits.com, which will allow them to browse and select their hotel stay booking and utilize their Hotel Cash Vouchers. Upon successful booking and utilization, Entrants will receive the booking email directly from the hotel selected.
viii. Should the Entrant have any question regarding the Hotel Cash Voucher or have misplaced their username and pin, they may contact the Administrator at customerservice_my@travelcredits.com or contact@belibelicuticuti.com or call +60 154 600 0047 for assistance.
ix. The Hotel Cash Vouchers are non-stackable and cannot be combined with any other promotion, discount, or coupon.
x. A maximum of three (3) entries are permitted per each Entrant, subject to the following:
a. Each entry must be accompanied by only one (1) Proof of Purchase per entry.
b. Each Proof of Purchase must be submitted separately and in accordance with entry requirements of these Terms and Conditions
xi. The Hotel Cash Vouchers under this Promotion are valid for 3 months from date of issuance.
xii. For the avoidance of doubt, the Promotion and the redemption of the Hotel Cash Vouchers is managed by the Administrator and the Promoter is not responsible for any issues, delays, errors, or disputes arising from the redemption process, the quality of the Hotel Cash Vouchers, or the services provided by the hotel.
9. The Promoter and the Administrator are not liable for any problems with communication networks, including but not limited to email blockage or incoming call rejections. If an Entrant enters using automatically generated entries or multiple phone numbers/ addresses/aliases, the said Entrant may be disqualified.
10. The Entrant must keep the physical or an image of the Proof of Purchase at the time of entry and until the redemption of Hotel Cash Vouchers. The Promoter or the Administrator, in its sole discretion, may at any time after a claim or an entry has been submitted, require the Proof of Purchase to be produced for verification before awarding any Hotel Cash Vouchers.
11. The Hotel Cash Vouchers are further subject to the additional terms & conditions detailed in Schedule 1.
OTHER GENERAL TERMS & CONDITIONS
12. The Promoter and the Administrator are not liable for lost, stolen or damaged Hotel Cash Vouchers and do not make any contractual promise or representation regarding the quality and/or availability of the hotel and cannot be held liable for any resulting personal loss or damage.
13. The Hotel Cash Vouchers are not transferable, exchangeable, or redeemable for cash. If the Hotel Cash Vouchers is unavailable, for whatever reasons, the Administrator reserves the right to substitute the Hotel Cash Vouchers for a reward of equal value and/or specification after consultation with the Promoter, and subject to any written approval from the relevant regulatory authorities if any.
14. All Promotion advertisements depicting the Hotel Cash Vouchers, descriptions and/or trademark references are illustrative rather than definitive and do not imply any association with the Promoter.
15. Without limiting to any other terms and conditions, the Hotel Cash Vouchers must be utilized as and when specified or will be forfeited with no replacement. The Hotel Cash Vouchers value is correct as of the date of preparing these Terms and Conditions.
16. In the event the Promotion is unable to proceed as set out in these Terms and Conditions, the Administrator reserves the right to vary these Terms and Conditions after consultation with the Promoter, and subject to any written approval from the relevant regulatory authorities if any.
17. The Administrator is not responsible for any tax implications arising from an Entrant utilizing or redeeming the Hotel Cash Vouchers. Entrants should seek independent financial advice.
18. The Promotional Website and hotel booking website are managed by the Administrator. The Promotion Website and hotel booking website may contain links to other websites (“Linked Sites”), including websites of promotional partners. The Promoter is not responsible for the Promotion Website, the hotel booking website, and any of the Linked Sites. Entrants agree to access them at their own risk.
19. Any additional or ancillary costs associated with redeeming and/or utilizing Hotel Cash Vouchers are not included. Those costs are the responsibility of the Entrant who redeems and/or utilizes the Hotel Cash Vouchers. Costs associated with redeeming and/or utilizing the Hotel Cash Vouchers may include, but are not limited to transportation fees, security deposit, etc.
20. Entrants must not:
i. tamper with the entry or participation process.
ii. engage in any conduct that may jeopardize the fair and proper conduct of the Promotion;
iii. act in a disruptive, annoying, threatening, abusive or harassing manner;
iv. do anything that may affect the good name or reputation of the Promoter or the Administrator or any of their related entities or of the agencies or companies associated with this Promotion.
v. breach any law; or
vi. behave in a way that is otherwise inappropriate.
21. Except for any liability that cannot be excluded by law, the Promoter (including its directors, officers, employees and agents) and the Administrator are not responsible for and exclude all liability (including for negligence) for any personal injury, death or harm suffered by the Entrant or other person who redeems the Hotel Cash Vouchers (and the Entrant or such person releases Promoter and the Administrator from any such liability) or any loss or damage (including loss of opportunity), whatsoever, whether direct, indirect, special or consequential, arising in any way out of:
i. any technical difficulties or equipment malfunction;
ii. any theft, unauthorised access or third-party interference.
iii. any claim that is late, lost, altered, damaged or misdirected due to any reasons;
iv. any variation in the Hotel Cash Vouchers value to that stated in these Terms and Conditions;
v. any tax liability incurred by an Entrant or claimant; or
vi. the use of a Hotel Cash Voucher.
22. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason, including by outside act, agent or event that is beyond the reasonable control of the Promoter or the Administrator, including but not limited to technical difficulties, epidemic, pandemic, government directive, public health orders and the like, unauthorised intervention or fraud, the Administrator reserves the right, in their sole discretion, to the fullest extent permitted by law and subject to any direction by a relevant regulatory authority:
i. to disqualify any Entrant; or
ii. to, after consultation with the Promoter, modify, suspend, terminate, or cancel the Promotion, as appropriate.
23. If any dispute arises between an Entrant and the Administrator concerning the conduct of this Promotion or claiming a Hotel Cash Vouchers, the Administrator will take reasonable steps to consider the Entrant's point of view, taking into account any facts or evidence they put forward, and to respond to it fairly within a reasonable time. Save for the dispute on Proof of Receipt which the Administrator will consult the Promoter, the Administrator’s decision in respect of the Promotion and redemption of Hotel Cash Vouchers is final.
24. All correspondence regarding this Promotion should be directed to the Administrator at this address or through the Promotional Helpline as set out below.
25. HELPLINE: For enquiries about the Promotion, consumers may call the Promotional Helpline on +60 154 600 0047 between the hours of 9:30am to 4:30pm during the Promotional Period, Monday to Friday, excluding Malaysia holidays, or email us at contact@belibelicuticuti.com.
26. Calls to the Promotional Helpline from public telephones or mobiles may incur an additional charge, which shall not be borne by the Administrator or Promoter. Calls may be recorded for the purposes of security and/or training purposes.
27. Participation to the Promotion is available online only, and therefore access to the internet is required to participate in this Promotion. Any cost associated with accessing the Promotional Website is the Entrant's sole responsibility and is dependent on the Internet service provider used by the Entrant.
28. This Promotion is in no way sponsored, endorsed, or administered by, or associated with any social media platform, including Facebook, Instagram, TikTok and Twitter. Entrants provide information to the Promoter and not to any social media platform. The Promoter and the Administrator assume no responsibility for any technical failures, unauthorized access, or other issues that may arise on any social media platform. By participating in this Promotion, Entrants agree to fully release and hold harmless both the Promoter and Administrator and any social media platforms from any and all claims, damages, liabilities, or losses arising from or in connection with their participation in the Promotion.
29. These Terms and Conditions are governed by Malaysian laws.
SCHEDULE 1 – ADDITIONAL TERMS AND CONDITIONS FOR HOTEL CASH VOUCHERS
30. Each successful entry will receive two (2) Hotel Cash Vouchers worth RM100 each.
• Hotel Cash Vouchers can be used towards worldwide hotel bookings on the hotel booking website https://en-my.travelcredits.com only.
• Each Hotel Cash Voucher is personal and non-transferable and can only be used by the person who is the holder of the voucher, who must be over 18 years of age.
• Each Hotel Cash Voucher is non-cumulative - only one voucher can be used per transaction/ booking.
• Each Hotel Cash Voucher cannot be exchanged for cash.
• Standard GST, service & credit card fees may apply when a Hotel Cash Voucher is redeemed.
• In the event of cancellation or amendment request, the request must be sent in writing, by email to customerservice_my@travelcredits.com between 09.00 – 16.00 weekdays only, requests much be received no later than an hour before close of business. Request of cancellation or amendment cannot be guaranteed, some hotels do not allow changes and therefore full cancellation charges will apply.
